Florida Dui Laws: Jail, Fines And License Suspension
Florida DUI laws postulate that a DUI offense can be established by either: 1) showing that your faculties were impaired due to alcohol severely enough to affect your driving, or 2) by administering abreath test that would indicate your BAC of over 0.08 percent. Florida DUI Laws: Jail
If the judge decides so, the jail term can be served at an approved residential drug and alcohol treatment facility.
1st DUI: six months. Nine months if your Blood Alcohol Content was over 0.2%, or if a minor was in the car when the offense occurred. 2nd DUI: nine months, unless your BAL was over .2 percent or a minor was present in the car. In this case Florida DUI Laws postulate twelve months in jail (at most). At least ten consequetive days of confinement must be served. 3d DUI: upto 12 months, with mandatory confinemnet of no less than thirty days. Subsequent DUI offenses may result ina jail sentence of upto 5 years.
Florida DUI Laws: Fines
1st DUI: between 250 and 500 dollars. Florida DUI Laws that this amount can be raised upto a thousand dollars if your BAL was severely higher than .08%, or if a child was in the vehicle. 2nd DUI Conviction: between 500 and 1000 dollars. Just like for the first offense, this amount can increase to upto $2000. 3d DUI: $1000-$5000, depending on the BAl and other factors underscoring the severity of the offense.
